Trading name of HP14 Fitness Limited

Document Version: 1.0
Effective Date: {sign_date}

1. PURPOSE OF THIS DOCUMENT

This Liability & Exercise Participation Waiver (“Waiver”) applies to your participation in physical activity, exercise, training and use of the facilities and equipment provided by HP29.

It applies to participation in:

- Open Gym;

- coached Training Sessions;

- Personal Training;

- Small Group Personal Training;

- trial sessions;

- Pay As You Gym sessions;

- exercise programmes;

- fitness assessments;

- demonstrations and instruction;

- use of gym equipment;

- use of studio space; and

- other physical activity provided or permitted by HP29.

This Waiver should be read together with the HP29 Membership Agreement, HP29 Gym Rules, HP29 Health & Fitness / PAR-Q Questionnaire and HP29 Privacy Notice.

This Waiver does not remove or restrict any legal rights or liability that cannot lawfully be excluded or restricted.

2. ACKNOWLEDGEMENT OF THE NATURE OF EXERCISE

I understand that physical exercise and participation in fitness activities involve inherent risks.

These risks may arise even where appropriate care is taken and may include, but are not limited to:

- muscle soreness;

- muscular strains;

- ligament or tendon injuries;

- sprains;

- joint injuries;

- aggravation of existing injuries or conditions;

- back or neck pain;

- falls;

- trips and slips;

- bruising;

- cuts or abrasions;

- impact injuries;

- dizziness or fainting;

- nausea;

- dehydration;

- overheating;

- fatigue;

- breathing difficulties;

- allergic reactions;

- cardiovascular events;

- changes in blood pressure;

- loss of consciousness;

- fractures;

- acute illness;

- and, in rare circumstances, serious injury or death.

I understand that the risk of injury may vary depending on my individual health, fitness, experience, age, technique, activity and circumstances.

I understand that exercise cannot be guaranteed to be free from risk.

3. MY RESPONSIBILITY TO EXERCISE SAFELY

I agree to exercise within my own capabilities and fitness level.

I understand that I am responsible for:

- listening to my body;

- using appropriate levels of resistance, intensity and difficulty;

- following reasonable instructions given by HP29 staff, Personal Trainers and instructors;

- using equipment appropriately;

- following the HP29 Gym Rules;

- following safety instructions;

- asking for assistance if I am unsure how to use equipment;

- stopping or modifying an exercise if I experience concerning symptoms;

- informing HP29 staff of relevant injuries or limitations;

- and seeking appropriate medical advice where necessary.

I understand that I should not attempt an exercise, movement, load or activity that I do not feel capable of performing safely.

4. HEALTH INFORMATION

I confirm that the health and fitness information I provide to HP29 is accurate and complete to the best of my knowledge.

I agree to inform HP29 of any relevant change to my health or circumstances that may affect my ability to exercise safely.

This includes, where relevant:

- new injuries;

- illness;

- surgery;

- pregnancy;

- postnatal recovery;

- cardiovascular conditions;

- respiratory conditions;

- neurological conditions;

- musculoskeletal conditions;

- joint problems;

- back or neck problems;

- medication changes;

- dizziness or fainting;

- chest pain;

- unexplained shortness of breath;

- or any other health concern that may affect exercise.

I understand that I should seek appropriate medical advice where I am uncertain whether exercise is appropriate for me.

5. MEDICAL CLEARANCE

HP29 may reasonably recommend or require medical clearance before participation in particular activities where there is a legitimate safety concern.

Where HP29 reasonably requires medical clearance, I agree not to participate in the relevant activity until the required clearance has been provided.

Any medical clearance provided to HP29 does not transfer responsibility for my participation entirely to my healthcare professional.

I remain responsible for following medical advice and informing HP29 of relevant restrictions or changes.

6. EMERGENCY MEDICAL ASSISTANCE

I understand that an emergency may occur while I am exercising.

If HP29 staff reasonably believe that I require urgent medical assistance, I authorise them, where reasonably necessary, to:

- contact emergency services;

- request medical assistance;

- provide reasonable first aid within their training and competence;

- provide relevant information to emergency responders;

- and take reasonable steps to protect my safety until appropriate medical assistance arrives.

I understand that HP29 staff are not medical professionals and that any first aid or emergency assistance will be provided within their level of training and competence.

Where I am conscious and able to communicate, HP29 will seek to respect my wishes where reasonably possible.

7. OPEN GYM PARTICIPATION

Where I use HP29 during Open Gym sessions, I understand that I am exercising independently.

Open Gym is not Personal Training.

Although an HP29 team member or Personal Trainer may be present and available to provide general assistance, they may not be monitoring my exercise continuously or supervising every movement I perform.

I am responsible for selecting appropriate exercises, loads, resistance levels and intensity unless I am receiving separate coaching.

I will ask an HP29 team member for assistance if I am unsure how to use equipment safely.

8. COACHED TRAINING SESSIONS

Where I participate in an HP29 coached Training Session, I understand that:

- exercises may be demonstrated and explained;

- I may be encouraged to work at an appropriate level of intensity;

- exercises may be adapted where reasonably possible;

- I remain responsible for communicating relevant limitations or concerns;

- and I may stop or modify an exercise if I believe it is inappropriate or unsafe for me.

I understand that a coach cannot know everything about my physical condition unless I have provided that information.

I agree to inform the coach before or during a session of any relevant injury, limitation, pain or health concern.

9. PERSONAL TRAINING

Where I participate in Personal Training, I understand that the purpose of the session is to provide individualised exercise instruction and coaching.

I understand that Personal Training does not constitute medical diagnosis, medical treatment or physiotherapy unless separately provided by an appropriately qualified healthcare professional.

I agree to communicate honestly with my Personal Trainer about:

- pain;

- injury;

- fatigue;

- limitations;

- previous injuries;

- medical conditions;

- pregnancy or postnatal considerations;

- and any other relevant factor affecting my ability to exercise.

I understand that exercise recommendations may be modified or stopped where my Personal Trainer reasonably considers this appropriate.

10. SMALL GROUP PERSONAL TRAINING

Where I participate in Small Group Personal Training, I understand that coaching is provided to more than one participant at a time.

Although exercises may be adapted where reasonably practicable, the coach cannot necessarily provide the same degree of individual attention as during one-to-one Personal Training.

I agree to communicate relevant limitations and concerns to the coach before or during the session.

11. USE OF GYM EQUIPMENT

I agree to use HP29 equipment only for its intended purpose.

I will:

- follow instructions;

- use appropriate loads;

- use safety mechanisms where provided;

- return equipment appropriately;

- avoid deliberately misusing equipment;

- report damaged or unsafe equipment;

- and ask for assistance if I am unfamiliar with equipment.

I understand that gym equipment can cause injury if used incorrectly, excessively or outside its intended purpose.

I accept responsibility for following reasonable equipment instructions and using equipment appropriately.

12. WEIGHTS, RESISTANCE EQUIPMENT AND FREE WEIGHTS

I understand that free weights, resistance equipment, barbells, dumbbells, kettlebells, cables, resistance machines and similar equipment can present risks including:

- dropping equipment;

- crushing or trapping injuries;

- impact injuries;

- strains;

- loss of balance;

- and injury caused by inappropriate loading or technique.

I agree to use appropriate weights and resistance for my ability.

I will use spotters or request assistance where reasonably necessary for an exercise that I cannot safely perform independently.

I will not deliberately drop, throw or misuse equipment except where the equipment and exercise are specifically designed for that purpose.

13. CARDIOVASCULAR AND HIGH-INTENSITY EXERCISE

I understand that cardiovascular and high-intensity exercise can place significant demands on the body.

Activities may include, for example:

- running;

- cycling;

- rowing;

- SkiErg;

- circuits;

- resistance training;

- interval training;

- conditioning exercises;

- and other high-intensity activities.

I understand that such activities may cause significant increases in heart rate, breathing rate, blood pressure and body temperature.

I agree to work within my capabilities and to stop or reduce intensity if I experience concerning symptoms.

14. PAIN, DISCOMFORT AND WARNING SYMPTOMS

I understand that some muscular fatigue, exertion and post-exercise soreness can occur during or following exercise.

However, I will not deliberately continue an exercise where I experience concerning symptoms.

I agree to stop exercising and seek assistance where appropriate if I experience symptoms including:

- chest pain or pressure;

- severe or unusual shortness of breath;

- fainting or near-fainting;

- severe dizziness;

- sudden severe headache;

- unusual weakness;

- confusion;

- loss of coordination;

- severe or unexpected pain;

- significant bleeding;

- or any other symptom that causes me serious concern.

I understand that HP29 staff are not responsible for diagnosing the cause of symptoms.

15. PRE-EXISTING CONDITIONS AND PREVIOUS INJURIES

I understand that exercise may aggravate an existing injury or medical condition.

I agree to disclose relevant pre-existing conditions, injuries or limitations that may affect safe participation.

I understand that HP29 may modify, restrict or decline an activity where reasonably necessary to protect my safety.

I understand that failure to disclose relevant information may increase the risk of injury.

Nothing in this clause means that HP29 accepts responsibility for conditions which it could not reasonably have known about.

16. PREGNANCY AND POSTNATAL EXERCISE

If I am pregnant, have recently given birth or am undergoing postnatal recovery, I agree to inform HP29 or my Personal Trainer where relevant.

I understand that pregnancy and the postnatal period may require modifications to exercise.

I understand that HP29 may recommend medical or healthcare-professional advice where appropriate.

I understand that postnatal exercise may require consideration of factors including:

- pelvic floor function;

- abdominal wall recovery;

- diastasis recti;

- pelvic or back pain;

- caesarean or other surgical recovery;

- hormonal and physiological changes;

- and individual recovery.

I understand that HP29’s fitness professionals are not a substitute for appropriate medical or specialist healthcare advice.

17. HYDRATION, NUTRITION AND FATIGUE

I understand that hydration, nutrition, sleep, illness, medication and fatigue may affect exercise performance and safety.

I agree to consider these factors when deciding whether and how intensely to exercise.

I understand that HP29 cannot monitor my hydration, nutrition, sleep or fatigue continuously.

I will inform an HP29 team member if I feel unable to exercise safely.

18. ENVIRONMENTAL AND FACILITY RISKS

I acknowledge that use of a commercial gym and studio environment may involve ordinary environmental risks, including:

- wet or slippery surfaces;

- steps and changes in floor level;

- moving equipment;

- other exercising members;

- noise;

- heat;

- ventilation;

- temporary equipment placement;

- cleaning activities;

- and normal movement around the facility.

I agree to take reasonable care for my own safety and to report hazards to HP29 as soon as reasonably possible.

HP29 will take reasonable care to maintain the facility and equipment in a safe condition.

19. INTERACTION WITH OTHER MEMBERS

I understand that other members may be exercising nearby and that activities can involve movement, weights and equipment.

I agree to exercise with reasonable consideration for others.

I will not deliberately interfere with another member’s exercise or place another person at unnecessary risk.

I will follow reasonable instructions from HP29 staff where necessary to maintain a safe training environment.

20. CHILDREN, YOUNG PEOPLE AND DEPENDANTS

Where children or young people are permitted to enter or participate in HP29 activities, the applicable age, supervision and safeguarding requirements must be followed.

A parent or guardian remains responsible for any child or young person in their care except to the extent that HP29 has expressly assumed responsibility for a particular supervised activity.

Children and young people must not use equipment or participate in activities for which they are not authorised or appropriately supervised.

21. PERSONAL BELONGINGS

I understand that I am responsible for my own personal belongings.

I should not bring unnecessary valuables into the facility or leave possessions unattended.

HP29 will take reasonable care in relation to property within its control but cannot guarantee the security of personal belongings.

Nothing in this section excludes liability which cannot legally be excluded.

22. ALCOHOL, DRUGS AND IMPAIRMENT

I must not participate in exercise at HP29 while impaired by:

- alcohol;

- recreational drugs;

- medication or substances that materially impair my ability to exercise safely; or

- any other condition causing significant impairment.

I understand that HP29 may refuse participation or require me to stop exercising where staff reasonably believe that I am impaired and that continuing to exercise could create a safety risk.

23. INFECTIOUS ILLNESS

I agree not to attend HP29 or participate in exercise where I have a contagious illness and reasonably believe that attending may put other members or staff at risk.

I will follow any reasonable health and hygiene requirements communicated by HP29.

24. HYGIENE AND CLEANING

I agree to follow reasonable hygiene requirements and use equipment responsibly.

Where cleaning materials are provided, I will use them appropriately.

I will report spills, bodily fluids or other hazards to HP29 staff promptly.

25. PHYSICAL CONTACT DURING TRAINING

I understand that certain exercises or coaching techniques may involve appropriate physical contact or proximity where reasonably necessary to provide instruction, positioning, spotting or safety assistance.

HP29 staff will use reasonable professional judgment and respect appropriate boundaries.

I may communicate that I do not wish to receive physical contact except where immediate physical assistance is reasonably necessary for safety.

26. TECHNOLOGY, PHONES AND RECORDING

I understand that I may not use phones, cameras or recording equipment in a way that compromises another person’s privacy, dignity or safety.

I must not deliberately record another member without their permission.

I will follow HP29’s current rules concerning photography, filming and use of devices within the facility.

27. PHOTOGRAPHY AND MARKETING

HP29 may take photographs or video for operational or marketing purposes.

Separate consent will be obtained where required for identifiable marketing use.

Agreeing to this Waiver does not by itself constitute consent to use my image for marketing.

28. FITNESS PROFESSIONAL QUALIFICATIONS AND SCOPE

I understand that HP29 fitness professionals provide exercise and fitness services within the scope of their qualifications and experience.

Fitness professionals do not provide medical diagnosis or treatment unless they separately hold an appropriate professional qualification and are acting within that scope.

I understand that exercise advice is not a substitute for medical advice where a medical assessment is required.

29. ACCURACY OF INFORMATION PROVIDED

I confirm that the information I provide to HP29 is accurate to the best of my knowledge.

I understand that HP29 relies on the information I provide when determining whether and how I participate in exercise.

I agree to notify HP29 if information that may affect my safe participation changes.

30. MY RESPONSIBILITY FOR MY OWN DECISIONS

I understand that I retain responsibility for decisions I make about my participation in exercise.

I may decline, stop or modify an exercise where I believe it is inappropriate for me, subject to reasonable instructions relating to safety.

I understand that I should communicate with my coach or Personal Trainer if I have concerns rather than silently continuing an activity that I believe may be unsafe.

31. ACKNOWLEDGEMENT OF ORDINARY EXERCISE RISKS

I acknowledge that I have been informed that exercise carries inherent risks.

I voluntarily choose to participate in physical activity knowing that these ordinary risks exist.

My acknowledgement of these risks does not mean that HP29 is released from responsibility for its own negligence, breach of contract, breach of statutory duty or any other liability which cannot legally be excluded or restricted.

32. HP29’S RESPONSIBILITY

HP29 will take reasonable care in providing its services and maintaining the facility and equipment.

Nothing in this Waiver excludes or restricts HP29’s liability for:

- death or personal injury caused by HP29’s negligence;

- fraud or fraudulent misrepresentation;

- breach of legal obligations that cannot lawfully be excluded;

- failure to provide services with reasonable care and skill where the law provides a remedy; or

- any other liability which cannot legally be excluded or restricted.

Any provision of this Waiver which purports to exclude or restrict such liability will apply only to the extent permitted by law.

33. DAMAGE TO PROPERTY

I agree to take reasonable care of HP29’s property and equipment.

I may be responsible for damage caused deliberately or through misuse where permitted by law.

HP29 will not seek to impose liability for ordinary wear and tear or damage resulting from reasonable use of equipment.

34. INJURY REPORTING

I agree to report any injury, accident, equipment failure or significant safety incident to HP29 as soon as reasonably practicable.

Where appropriate, HP29 may record details of the incident for health, safety, insurance, legal or operational purposes.

35. EMERGENCY EVACUATION

I agree to follow HP29’s emergency procedures and reasonable instructions during an evacuation or other emergency.

I will not deliberately obstruct emergency exits, fire equipment or emergency access routes.

I understand that emergency procedures may require me to stop exercising immediately and leave equipment and personal belongings behind.

36. FIRST AID AND EMERGENCY INFORMATION

I understand that HP29 may maintain appropriate first aid equipment and emergency procedures.

I will provide relevant emergency contact information where requested.

I understand that emergency contact information will be used for appropriate emergency or safeguarding purposes.

37. NO GUARANTEE OF RESULTS

I understand that participation in HP29 exercise or training does not guarantee any particular physical, fitness, strength, weight, body composition, rehabilitation or performance result.

Results may vary depending on numerous factors, including:

- attendance;

- exercise adherence;

- nutrition;

- sleep;

- health;

- genetics;

- lifestyle;

- training history;

- recovery;

- and individual circumstances.

Any examples or targets discussed by HP29 or its fitness professionals are not guarantees of a particular outcome.

38. LIABILITY AND STATUTORY RIGHTS

This Waiver is intended to record my informed acknowledgement of the ordinary risks of physical activity and my responsibilities as a participant.

It is not intended to exclude or restrict any legal liability that HP29 is prohibited from excluding or restricting.

Nothing in this Waiver affects my statutory rights as a consumer.

Nothing in this Waiver prevents me from bringing a legitimate claim where HP29 is legally responsible.

39. SEPARATE FROM MEMBERSHIP TERMS

This Waiver forms part of my participation arrangements with HP29 but is separate from the HP29 Membership Agreement.

The Membership Agreement governs matters including:

- membership;

- fees;

- payment;

- cancellation;

- access;

- booking;

- suspension;

- termination;

- and other contractual matters.

This Waiver concerns participation in exercise and use of the facilities.

The HP29 Gym Rules govern day-to-day conduct and facility requirements.

10. I understand that HP29 fitness professionals are not medical professionals and do not provide medical diagnosis or treatment unless separately qualified and acting within that professional scope.

11. I understand that I should seek appropriate medical advice where necessary.

12. I understand the distinction between Open Gym, coached Training Sessions, Personal Training and Small Group Personal Training.

10.2 Unless expressly stated otherwise, these products are non-recurring.

12.3 Different services may have different cancellation arrangements.

12.4 Where a particular service has a specific cancellation or no-show policy, that policy will apply to that service.

12.5 HP29 may reasonably restrict future bookings where there is repeated misuse of the booking system, repeated non-attendance or repeated late cancellation.

12.6 Any such restriction will be applied reasonably and proportionately.

13. MEMBERSHIP FEES

13.1 You agree to pay the price displayed for your selected membership at the time you enter into the agreement.

13.2 For a recurring membership, the applicable recurring price will be clearly shown to you before you complete your purchase.

13.3 Any mandatory charges that form part of your membership price will be disclosed before you purchase the membership.

13.4 HP29 does not currently charge a joining fee unless one is specifically displayed as part of the membership you are purchasing.

13.5 Where your membership starts part way through a billing period, your initial payment may be calculated on a pro-rata basis where applicable.

13.6 Subsequent recurring payments will normally be collected in accordance with the payment schedule shown to you at sign-up.

13.7 HP29 may use GoCardless or another payment provider to collect recurring payments.

14. PAYMENT AUTHORISATION

14.2 You are responsible for ensuring that the payment details you provide remain accurate and that sufficient funds are available when payment is due.

14.3 If your payment details change, you should update them promptly through the applicable payment or membership system.

14.4 You remain responsible for payment even if you do not attend the facility during a period in which your membership remains active.

15. FAILED OR OVERDUE PAYMENTS

15.1 If a payment fails, HP29 may attempt to collect the outstanding amount again using the payment method you have authorised.

15.2 You remain responsible for any membership fees that are properly due.

15.3 Where an amount remains overdue, HP29 may restrict access to bookings, sessions or the facility in accordance with its current payment and access procedures.

15.4 A restriction of access because of overdue payment does not automatically cancel your membership.

15.5 Unless your membership has been properly cancelled, terminated or otherwise ended, membership fees will continue to become due in accordance with your membership terms.

15.6 HP29 will not charge a late payment fee unless such a fee has been clearly communicated to you before it becomes applicable.

16. ROLLING MONTHLY MEMBERSHIPS

16.1 Unless your Membership Summary or specific membership terms state otherwise, an ongoing monthly membership is a rolling membership with no fixed minimum term.

16.2 A rolling membership continues from month to month until it is cancelled in accordance with this Agreement.

16.3 You may cancel an ongoing monthly membership at any time by giving one month’s notice.

16.4 You do not need to wait until your next payment date to give notice.

16.5 Your membership will remain active during the applicable notice period.

16.6 Membership fees properly falling due during the notice period remain payable.

16.7 Once the notice period has expired, your membership will end and no further recurring payments will be due, subject to any outstanding amounts properly owed.

16.8 If a payment has been collected for a period extending beyond your membership end date, HP29 will refund any amount properly due to you for the period after your membership has ended.

16.9 You do not need to provide a reason for cancelling your membership.

16.10 Cancellation instructions will be provided through the HP29 membership system or another reasonable method communicated to you.

17. MEMBERSHIP SUSPENSION

17.1 Unless your particular membership expressly includes a freeze or suspension facility, you cannot assume that membership payments can be paused simply because you are temporarily unable or choose not to attend.

17.2 Where HP29 offers membership suspension, the applicable terms, charges and maximum suspension period will be communicated before the suspension is agreed.

17.3 HP29 may also temporarily suspend access where reasonably necessary for:

- safety;

- serious misconduct;

- non-payment;

- investigation of a serious breach; or

- other circumstances where immediate action is reasonably necessary.

17.4 A suspension imposed by HP29 is different from a member-requested membership freeze.

18. ACCESS TO THE FACILITY

18.1 Access to HP29 is conditional upon:

- having an active membership or valid session entitlement;

- complying with this Agreement;

- complying with the HP29 Gym Rules;

- complying with applicable booking requirements; and

- keeping payments up to date.

18.2 HP29 may restrict access where reasonably necessary because of:

- overdue payment;

- serious or repeated breach of this Agreement;

- serious or repeated breach of the Gym Rules;

- safety concerns;

- abusive, threatening or violent behaviour;

- misuse of membership access; or

- other circumstances where restriction is reasonably necessary to protect members, staff, the facility or the proper operation of HP29.

18.3 Where reasonably practicable, HP29 will give you an opportunity to remedy a breach before restricting access.

18.4 Where immediate action is reasonably necessary for safety, security or other serious reasons, HP29 may act without prior notice.

19. CHECK-IN AND MEMBERSHIP ACCESS

19.1 You must use your own membership credentials and the applicable HP29 check-in process when attending the facility.

19.2 You must not allow another person to check in using your membership.

19.3 HP29 may use its membership and attendance system to record attendance and manage access.

19.4 You may be required to have an active membership, valid booking or other valid entitlement before access is permitted.

19.5 HP29 may refuse access where your membership is inactive, suspended, cancelled, overdue or otherwise not valid for the service you are attempting to access.

20. GYM RULES AND MEMBER CONDUCT

20.1 You agree to comply with the current HP29 Gym Rules.

20.2 The Gym Rules form part of your membership arrangements.

20.3 You must behave respectfully towards HP29 staff, contractors, other members and visitors.

20.4 You must not:

- behave violently or aggressively;

- threaten, intimidate, harass or abuse another person;

- engage in discriminatory or unlawful behaviour;

- deliberately damage HP29 property;

- misuse gym equipment;

- deliberately disregard reasonable safety instructions;

- allow another person to use your membership;

- attempt to bypass HP29’s access or booking systems; or

- otherwise behave in a way that materially disrupts the safe or reasonable operation of HP29.

20.5 You must follow reasonable instructions given by HP29 staff in relation to safety, security and the operation of the facility.

20.6 The detailed Gym Rules will be provided separately and must be read and acknowledged as part of the membership sign-up process.

21. SAFE USE OF EQUIPMENT

21.1 You must use HP29 equipment responsibly and for its intended purpose.

21.2 You must follow:

- HP29 instructions;

- equipment instructions;

- manufacturer instructions where applicable; and

- reasonable instructions given by HP29 staff.

21.3 If you are unsure how to use equipment safely, you should ask an HP29 team member before using it.

21.4 You must report damaged, defective or unsafe equipment to HP29 as soon as reasonably possible.

21.5 You must not knowingly use equipment that appears unsafe or damaged.

22. HEALTH AND FITNESS

22.1 You must provide accurate information requested by HP29 about your health, fitness, injuries and other circumstances that may reasonably affect your ability to exercise safely.

22.2 You must tell HP29 if there is a significant change in your health or circumstances that may affect your ability to exercise safely.

22.3 You are responsible for obtaining appropriate medical advice if you are unsure whether exercise is suitable for you.

22.4 HP29 may reasonably require medical clearance before allowing participation in a particular activity where there is a legitimate safety concern.

22.5 You should not exercise if you are unwell or believe that exercising may put you or another person at risk.

22.6 HP29 staff and Personal Trainers are not medical professionals and HP29 does not provide medical diagnosis or treatment.

22.7 Any health screening, PAR-Q or health questionnaire completed by you forms part of the information HP29 uses to manage your participation safely. It does not replace professional medical advice.

23. PERSONAL RESPONSIBILITY DURING EXERCISE

23.1 You acknowledge that exercise and physical activity involve inherent risks, including the possibility of injury.

23.2 You are responsible for exercising within your own capabilities and for following reasonable safety instructions.

23.3 You must stop exercising and seek appropriate assistance if you feel unwell, experience unusual pain, dizziness, difficulty breathing or any other concerning symptom.

23.4 Nothing in this Agreement requires you to participate in an activity which you reasonably believe is unsafe for you.

23.5 The separate HP29 Liability and Exercise Participation Waiver provides further information about participation in physical activity.

24. TEMPORARY CLOSURES AND DISRUPTION

24.1 HP29 may occasionally need to close all or part of the facility temporarily.

24.2 Reasons may include:

- maintenance;

- repairs;

- equipment replacement;

- health and safety;

- emergencies;

- utility failure;

- circumstances outside HP29’s reasonable control; or

- other legitimate operational reasons.

24.3 Where reasonably possible, HP29 will provide advance notice of planned closures.

24.4 HP29 will take reasonable steps to minimise disruption to members.

24.5 Where a closure materially affects services for which you have paid, HP29 will consider an appropriate remedy depending on the circumstances, which may include:

- alternative access;

- replacement sessions;

- an extension of access; or

- a proportionate refund where appropriate.

24.6 Nothing in this clause removes any statutory rights you may have.

25. CHANGES TO SERVICES

25.1 HP29 may reasonably change aspects of its services and facilities from time to time.

25.2 This may include changes to:

- session times;

- instructors;

- session formats;

- equipment;

- opening arrangements;

- booking procedures;

- membership products;

- training programmes; or

- operational procedures.

25.3 HP29 will take reasonable steps to communicate material changes affecting existing members.

25.4 HP29 will not use this clause to make a fundamentally different agreement with you without appropriate notice and consideration of your contractual and statutory rights.

25.5 Where a material change significantly reduces a service included in your existing membership, HP29 will consider an appropriate remedy depending on the nature and duration of the change.

26. MEMBERSHIP PRICE CHANGES

26.1 The price of your membership is the price shown to you when you enter into the membership.

26.2 If HP29 proposes to change the price of an ongoing membership, we will provide reasonable advance notice of the proposed change and the date on which the new price will apply.

26.3 Any mandatory charges forming part of the new price will be clearly communicated.

26.4 Where the law gives you a right to cancel because of a price or contractual change, nothing in this Agreement removes that right.

26.5 HP29 will not use a general right to amend this Agreement as a means of imposing an unfair or unexpected price increase without appropriate notice.

27. PERSONAL BELONGINGS

27.1 You are responsible for your personal belongings while at HP29.

27.2 You should not leave valuable possessions unattended.

27.3 HP29 does not accept responsibility for loss, theft or damage to personal belongings except where such liability cannot lawfully be excluded or where the loss or damage results from HP29’s failure to exercise reasonable care.

28. LIABILITY

28.1 HP29 will provide its services with reasonable care and skill.

28.2 Nothing in this Agreement excludes or limits liability which cannot legally be excluded or limited.

28.3 This includes liability for:

- death or personal injury caused by negligence;

- fraud or fraudulent misrepresentation; and

- any other liability which the law does not permit HP29 to exclude or restrict.

28.4 You remain responsible for following reasonable safety instructions and for using equipment appropriately.

28.5 HP29 will not be responsible for loss or damage arising solely from your failure to follow reasonable instructions, misuse of equipment or deliberate unsafe behaviour, subject always to your statutory rights and any liability which cannot lawfully be excluded.

28.6 Nothing in this Agreement excludes or restricts your statutory rights as a consumer.

29. PHOTOGRAPHY, VIDEO AND CCTV

29.1 CCTV may operate within or around HP29 for legitimate purposes including security, safety and the protection of members, staff and property.

29.2 Further information about CCTV and personal data is contained within the HP29 Privacy Notice.

29.3 HP29 may from time to time take photographs or video for legitimate operational, training or marketing purposes.

29.4 Where identifiable images of you are to be used for marketing purposes, the appropriate consent will be obtained separately where required.

29.5 You may withdraw marketing image consent at any time, subject to lawful use that has already taken place.

30. PERSONAL DATA

30.1 HP29 will collect and process your personal information in accordance with applicable data protection law and the HP29 Privacy Notice.

30.2 Your information may be used where necessary to:

- create and administer your membership;

- process payments;

- manage bookings;

- record attendance;

- communicate with you;

- operate and secure the facility;

- manage health and safety;

- provide training and fitness services;

- comply with legal obligations; and

- otherwise manage the legitimate operation of HP29.

30.3 Where HP29 collects health information or other special category personal data, it will be handled in accordance with applicable data protection requirements.

30.4 Further information about how your personal information is collected, used, stored and protected, together with your rights, is contained within the HP29 Privacy Notice.

31. STATUTORY CANCELLATION RIGHTS

31.1 If you enter into your membership contract as a consumer at a distance, for example online, you may have a statutory right to cancel the contract within 14 calendar days, subject to the applicable legal rules and any applicable exceptions.

31.2 Where a statutory cancellation right applies, you do not normally need to provide a reason for cancellation.

31.3 If you expressly request that HP29 begins providing services during the applicable cancellation period, and you subsequently cancel during that period, you may be required to pay a proportionate amount for services supplied up to the point at which you notify HP29 of cancellation, where permitted by law.

31.4 Where the applicable legal requirements for full performance of a service are satisfied following your express request and acknowledgement, your statutory right to cancel may cease in accordance with the law.

31.5 Nothing in this Agreement removes or restricts any statutory cancellation right which applies to you.

32. HOW TO EXERCISE A STATUTORY CANCELLATION RIGHT

32.1 If you have a statutory right to cancel and wish to exercise it, you must communicate your decision clearly to HP29.

32.2 You may contact HP29 using:

Email: info@hp14fitness.co.uk

Postal address:
HP29, Unit 29 Vernon Building, Westbourne St, High Wycombe, HP11 2PX

32.3 You may also use any cancellation facility provided through the HP29 membership system where available.

32.4 You may use the model cancellation wording included at the end of this Agreement, but you are not required to use that wording.

32.5 To meet a statutory cancellation deadline, it is sufficient for you to send your cancellation communication before the applicable cancellation period expires.

33. CANCELLATION BY YOU

33.1 Your statutory cancellation rights under Section 31 are separate from your contractual right to cancel an ongoing membership under Section 16.

33.2 Once any applicable statutory cancellation period has ended, an ongoing membership may still be cancelled in accordance with the contractual cancellation arrangements applicable to your membership.

33.3 For a standard ongoing monthly membership, the contractual cancellation period is one month.

33.4 Cancellation does not remove any payment obligation which arose before the effective cancellation date.

34. TERMINATION OR SUSPENSION BY HP29

34.1 HP29 may suspend or terminate your membership where reasonably necessary because of:

- serious or repeated breach of this Agreement;

- serious or repeated breach of the Gym Rules;

- serious or repeated misuse of the booking or membership system;

- abusive, threatening or violent behaviour;

- deliberate damage to HP29 property;

- fraudulent activity;

- sharing or misuse of membership access; or

- continued non-payment of amounts properly due.

34.2 Where appropriate, HP29 will give you reasonable notice and an opportunity to remedy the issue.

34.3 Where immediate action is reasonably necessary to protect members, staff, property or the operation of the facility, HP29 may suspend access or terminate the membership immediately.

34.4 If HP29 terminates a membership for a reason other than your breach or another legitimate reason attributable to you, HP29 will refund any amount properly due for services paid for but not provided, subject to your statutory rights.

34.5 Termination does not affect rights or obligations which arose before termination.

35. ACCESS CREDENTIALS AND ACCOUNT SECURITY

35.1 Your membership account and access credentials are personal to you.

35.2 You must keep your login details, access codes and other security information confidential.

35.3 You must not give your credentials to another person.

35.4 You must notify HP29 promptly if you believe your account or access credentials have been compromised.

35.5 HP29 may update or replace access systems where reasonably necessary for security or operational reasons.

36. CHILDREN AND YOUNG PEOPLE

36.1 Where HP29 offers memberships or services to persons under the age of 18, additional age, consent, safeguarding or supervision requirements may apply.

36.2 Where applicable, those requirements will be communicated before the relevant membership or service is purchased.

36.3 Nothing in this Agreement permits a person to use a service where they do not meet HP29’s applicable age or eligibility requirements.

37. COMPLAINTS

37.1 HP29 wants to resolve complaints fairly and promptly.

37.2 If you have a complaint, please contact:

Email: Info@hp14fitness.co.uk

37.3 Please provide enough information for us to understand the issue and, where possible, explain what outcome you are seeking.

37.4 HP29 will review complaints reasonably and will aim to respond within a reasonable period.

37.5 Nothing in the complaints process prevents you from exercising any statutory rights you may have.

38. CHANGES TO THIS AGREEMENT

38.1 HP29 may need to update this Agreement from time to time to reflect:

- changes in the law;

- regulatory requirements;

- safety requirements;

- changes to technology or systems;

- changes to the operation of HP29; or

- other legitimate business or operational requirements.

38.2 Where a change materially affects your existing rights or obligations, HP29 will provide reasonable notice.

38.3 Where required by law, you will be given any applicable right to cancel or other remedy arising from a material change.

38.4 HP29 will not use this provision simply to impose an unfair or materially different bargain on existing members without appropriate notice and consideration of their rights.

38.5 The version of the Agreement applicable to your membership will be retained within HP29’s membership records.

39. THIRD-PARTY SERVICES AND CONTRACTORS

39.1 HP29 may use employees, contractors, Personal Trainers, instructors, payment providers, booking systems and other service providers in operating the business.

39.2 Where a service is provided by an independent contractor, the contractor may have additional terms relating to their particular service.

39.3 Any additional terms will be communicated to you where they apply to a service you purchase.

39.4 The use of contractors or third-party service providers does not remove HP29’s obligations under this Agreement where HP29 is responsible for the relevant service.

40. MEMBERSHIP TRANSFERS

40.1 Your membership is personal to you.

40.2 You may not sell, transfer or assign your membership to another person without HP29’s prior agreement.

40.3 HP29 may transfer or assign the operation of the business or membership arrangements to another operator where appropriate, provided this does not unfairly reduce your contractual or statutory rights.

41. NOTICES AND COMMUNICATION

41.1 HP29 may communicate with you using the contact details associated with your membership account.

41.2 You are responsible for keeping your contact information accurate.

41.3 Important membership communications may be sent by email, through the HP29 membership portal, through the booking system or by another reasonable method.

41.4 You should check communications from HP29 relating to your membership.

42. IF PART OF THIS AGREEMENT IS INVALID

42.1 If any provision of this Agreement is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

42.2 This does not affect any statutory rights you have.

43. NO WAIVER

43.1 If HP29 does not immediately enforce a provision of this Agreement, this does not mean that HP29 has permanently waived the right to enforce it later.

43.2 Any waiver by HP29 must be reasonable and does not remove any statutory rights you have.

44. ENTIRE MEMBERSHIP AGREEMENT

44.1 This Agreement, together with:

- the membership information provided to you at sign-up;

- any applicable membership-specific terms;

- the HP29 Gym Rules;

- the HP29 Privacy Notice;

- the HP29 Health and Fitness / PAR-Q information; and

- any other terms expressly incorporated into your membership,

- forms the agreement between you and HP29 in relation to your membership.

44.2 Where additional terms apply specifically to a particular service, those terms will be made available to you before you purchase or use that service.

44.3 If there is a conflict between this Agreement and a specific membership term, the specific membership term will apply only to the extent necessary to deal with that particular service or membership feature.

44.4 If there is any ambiguity in a consumer term, it will be interpreted in accordance with applicable consumer law.

45. GOVERNING LAW

45.1 This Agreement is governed by the law of England and Wales.

45.2 The courts of England and Wales will have jurisdiction in relation to this Agreement, subject to any mandatory rights a consumer may have to bring proceedings in another jurisdiction.

Based on the information I have provided:

I have disclosed a health condition, injury or concern which may require modification of exercise.

I believe I should obtain medical or healthcare-professional advice before participating in some or all exercise.

I have already been advised by a healthcare professional that exercise is appropriate for me.

I am unsure whether exercise is appropriate for me.

Additional information:

SECTION 35 — INFORMATION SHARING WITH YOUR PERSONAL TRAINER

I understand that this questionnaire may contain health information which is relevant to the safe delivery of my exercise programme.

Where I engage an HP29 Personal Trainer or Small Group Personal Trainer, I consent to HP29 making relevant information from this questionnaire available to that fitness professional for the purposes of:

- assessing my readiness for exercise;

- identifying relevant risks or limitations;

- designing and adapting my exercise programme;

- delivering exercise safely;

- monitoring relevant changes;

- and making appropriate referrals where necessary.

I understand that my Personal Trainer should only use this information for legitimate purposes connected with my exercise and fitness service and should handle it appropriately.

I consent to relevant information from this health screening being shared with the HP29 Personal Trainer or fitness professional working with me.

SECTION 36 — UPDATES TO THIS QUESTIONNAIRE

I agree to inform HP29 if there is a significant change in my health, injury status, medication, pregnancy status or any other circumstance which may affect my ability to exercise safely.

I understand that HP29 may ask me to complete an updated health screening questionnaire where:

- there has been a significant change in my health;

- I have experienced a significant injury;

- I have undergone surgery;

- I have been diagnosed with a new medical condition;

- there has been a significant period away from exercise;

- my Personal Trainer reasonably considers an update appropriate;

- or HP29 otherwise reasonably considers an updated assessment necessary.

I understand that:

1. This questionnaire is intended to support safe participation in exercise.

2. It is not a medical examination or diagnosis.

3. Completing this questionnaire does not guarantee that exercise is medically safe for me.

4. I should seek appropriate medical advice if I am uncertain about my ability to exercise safely.

5. I must tell HP29 if my health or circumstances change in a way that may affect exercise.

6. I am responsible for communicating relevant symptoms, injuries and limitations to my fitness professional.

7. HP29 and its fitness professionals may modify or stop exercise where reasonably necessary for safety.

8. My completed questionnaire may be used by an HP29 Personal Trainer or other appropriately authorised fitness professional involved in providing my exercise services.

HP29 GYM RULES

Train hard. Train safely. Respect the space. Respect the people in it.

These Gym Rules are designed to help everyone enjoy HP29, train safely and make the most of the facility.

They apply to everyone using HP29, including members, guests, trial users, Personal Training clients, Small Group Personal Training clients, participants in Training Sessions and anyone attending a specific children’s or youth session.

These Gym Rules should be read alongside the HP29 Membership Agreement, HP29 Liability & Exercise Participation Waiver, HP29 Pre-Exercise Health Screening & Readiness Questionnaire (PAR-Q) and HP29 Privacy Notice, where applicable.

1. ACCESS TO HP29

- You must have a valid membership, booking, trial, Personal Training appointment, Small Group Personal Training appointment or other authorised access arrangement to use HP29.

- You must check in using the HP29 check-in system when you arrive.

- You must only use areas, equipment and sessions that your membership or booking permits.

- Please follow reasonable instructions given by HP29 staff, Personal Trainers or instructors.

- Do not allow another person to use your membership, account, access credentials or check-in details.

- HP29 reserves the right to refuse or restrict access where there is a legitimate health, safety, behavioural or operational reason to do so, in accordance with the Membership Agreement.

2. AGE REQUIREMENTS

The minimum age for general HP29 membership is 16.

Members aged 16–17

Members under 18:

- must have appropriate parent/guardian consent;

- must have a parent/guardian involved in their membership arrangements as required by HP29;

- may use Open Gym from age 16, subject to the supervision requirements set by HP29;

- must have appropriate supervision from a parent/guardian when using Open Gym;

- must follow all HP29 rules and staff instructions.

Under-18s may participate in Personal Training where the Personal Trainer has the appropriate qualifications, insurance and experience to train someone of that age.

Under 16s

Under-16s cannot use Open Gym or general HP29 membership facilities.

They may only attend HP29 as part of a specific children’s or youth Training Session designed and authorised for their age group.

Children attending such sessions must follow the requirements communicated for that session.

3. BOOKING AND ATTENDING SESSIONS

Where a session requires a booking:

- You must book through the approved HP29 booking system.

- Only book sessions you genuinely intend to attend.

- If you can no longer attend, please cancel your booking as soon as possible.

- Do not attend a session using another member’s booking or account.

- Do not deliberately book spaces you do not intend to use.

- Session capacity limits must be respected.

- You may only participate in a Training Session if you are appropriately booked or otherwise authorised to attend.

Booking, cancellation and membership access arrangements are governed by the current HP29 booking system and Membership Agreement.

4. OPEN GYM

Open Gym is intended for independent exercise within a supervised environment.

During Open Gym:

- You are responsible for choosing exercises appropriate to your ability and experience.

- Staff may provide general assistance or safety guidance, but Open Gym is not a Personal Training session.

- If you are unsure how to use a piece of equipment, ask a member of staff before using it.

- Do not attempt exercises or use equipment beyond your current ability simply because another member is doing so.

- Respect other members’ space and allow appropriate time for equipment sharing.

- Keep walkways, entrances, exits and access routes clear.

5. TRAINING SESSIONS

Training Sessions are coach/instructor-led sessions.

Participants are expected to:

- arrive prepared and ready to train;

- follow reasonable instructions from the coach or instructor;

- work at an appropriate level for their own ability;

- tell the coach about any relevant injury, illness or limitation before the session;

- use equipment as instructed;

- respect other participants;

- stop or modify an exercise if instructed to do so for safety reasons.

If you are unsure about an exercise or movement, ask.

There is no prize for being the person who pushes through an exercise that isn’t right for them.

6. PERSONAL TRAINERS, COACHES & PROFESSIONAL CONDUCT

HP29 may have a number of Personal Trainers, coaches and other fitness professionals working within the facility. This allows members to access a range of training services while maintaining a professional and safe environment.

Authorised Trainers and Coaches

- Only Personal Trainers, coaches and fitness professionals who have been authorised by HP29 may provide paid coaching or Personal Training services within the facility.

- Trainers and coaches must operate within their relevant qualifications, professional competence and insurance.

- Members must not provide paid Personal Training, coaching or exercise instruction to other members at HP29 unless they are specifically authorised to do so by HP29.

- Members may train together socially or assist one another informally, but must not present themselves as an HP29 Trainer or provide professional coaching without authorisation.

Respecting Training Sessions

- Members should not interrupt, distract or interfere with another person’s Personal Training or coached session.

- Please give Trainers and their clients appropriate space to work safely.

- Do not approach or attempt to recruit, solicit or sell services to another member while they are participating in a Personal Training or coached session.

- Trainers may provide general safety guidance to members using Open Gym where appropriate, but this does not turn Open Gym into a Personal Training session.

- Members participating in Personal Training or Small Group Personal Training must follow reasonable instructions given by their Trainer.

Working With Your Own Trainer

You are welcome to use an HP29-authorised Personal Trainer where your membership or booking arrangements allow.

Where a Trainer is operating independently or under a separate arrangement with HP29, there may be a separate agreement between you and that Trainer. Your Trainer is responsible for the services they provide to you, within the scope of their professional role.

HP29 may require Trainers to maintain appropriate qualifications, insurance and professional standards as a condition of working within the facility.

Professional Boundaries

HP29 is committed to maintaining a professional training environment.

Unwanted physical contact, inappropriate comments, sexual behaviour, harassment, intimidation or other conduct that crosses reasonable professional boundaries will not be tolerated.

Physical contact may sometimes be appropriate during exercise instruction, for example to assist with positioning, technique or safety. Trainers should communicate appropriately and obtain appropriate agreement before physical contact where reasonably practicable.

Any concern about inappropriate conduct should be reported to HP29 management.

7. PERSONAL TRAINING & SMALL GROUP PERSONAL TRAINING

Personal Training and Small Group Personal Training are coached services.

Your Trainer is responsible for delivering the service within their professional scope, but you remain responsible for communicating relevant information about your health, injuries, symptoms and ability to exercise.

Please tell your Trainer if:

- an exercise causes pain or unusual symptoms;

- your health or medication has changed;

- you have developed an injury or illness;

- you have received new medical or healthcare advice;

- you are unable to safely perform an exercise.

You must follow reasonable safety instructions given by your Trainer.

8. USING EQUIPMENT RESPONSIBLY

HP29 equipment is provided for appropriate training purposes.

Please:

- use equipment only for its intended purpose;

- check equipment before use and report anything damaged or unsafe;

- ask if you are unsure how to use something;

- use appropriate weights for your ability;

- keep equipment under control;

- return equipment after use;

- keep plates, dumbbells, kettlebells and other equipment in their designated storage areas;

- leave equipment in a safe condition for the next person.

Moving Equipment

Equipment may be moved where appropriate for your training.

If you move equipment:

Put it back when you’re finished.

Equipment must be returned to its designated or safe storage position so that it does not create a trip hazard, obstruct access or interfere with another member’s training.

9. DROPPING WEIGHTS

Do not deliberately drop weights.

Weights should be controlled and returned safely to the floor or storage area wherever reasonably possible.

This includes dumbbells, kettlebells, plates, bars and other equipment.

If equipment is specifically designed to be safely dropped in a particular training environment or exercise, follow the instructions of the Trainer or HP29 staff.

Repeated or inappropriate dropping of weights may be treated as misuse of equipment.

10. LIFTING AND ADVANCED EXERCISES

HP29 welcomes a wide range of training styles, including strength training and Olympic lifting.

You may perform advanced exercises where:

- you have the appropriate experience and ability;

- the exercise can be performed safely;

- there is sufficient space;

- the equipment is appropriate;

- you are not creating an unreasonable risk to yourself or others.

If you are unsure whether an exercise or setup is appropriate, ask a member of staff.

Train within your ability rather than trying to prove it.

11. CHALK AND OTHER TRAINING PRODUCTS

Chalk may be used where appropriate for training.

Please:

- use it sensibly;

- avoid unnecessary mess;

- clean up after yourself;

- do not leave chalk on equipment, floors or other surfaces.

The same principle applies to any other training product you bring into HP29.

If you make a mess, clean it up.

12. CLOTHING AND FOOTWEAR

Please wear clothing that is appropriate for exercise and suitable for the activity you are undertaking.

Trainers are not compulsory, but footwear must be appropriate for the activity and environment.

For hygiene and safety reasons:

- heavily soiled outdoor footwear should not be worn;

- sliders, slippers or other inappropriate footwear should not be worn while exercising;

- footwear should provide an appropriate level of stability for the activity being performed.

Staff may ask you to change footwear or clothing if what you are wearing presents a reasonable safety or hygiene concern.

13. FOOD AND DRINKS

We don’t want to be unnecessarily fussy about what you bring into HP29.

Please simply use common sense.

- Keep drinks in suitable, secure containers.

- Take care around equipment and electrical items.

- Clean up any spills immediately.

- Food should not be consumed in a way that creates a hygiene, safety or mess issue.

- Protein shakes and similar drinks are permitted where used sensibly.

- Hot drinks may be consumed in appropriate areas, but should not be placed where they could spill onto equipment or create a hazard.

HP29’s coffee facilities may be used by members, Trainers and staff in accordance with any instructions provided.

14. HYGIENE AND CLEANLINESS

Please help us keep HP29 clean and pleasant for everyone.

- Wipe down equipment after use where appropriate.

- Use the cleaning products provided by HP29 as directed.

- Dispose of rubbish properly.

- Do not leave towels, clothing, bottles or personal belongings around the gym.

- Clean up chalk, sweat, drinks or other mess you create.

- Use appropriate personal hygiene when training.

If you notice a cleaning, hygiene or maintenance issue, please tell a member of staff.

15. SHARING EQUIPMENT & GYM ETIQUETTE

HP29 is a shared training environment.

Please:

- be considerate of other members;

- allow others to use equipment where appropriate;

- avoid unnecessarily occupying equipment while using your phone or taking extended breaks;

- don’t monopolise equipment during busy periods;

- ask before taking equipment someone is actively using;

- return equipment when finished;

- keep your training area tidy;

- give other people adequate space to exercise safely.

A simple “Are you using this?” goes a long way.

16. PHONES, PHOTOGRAPHY & FILMING

We understand that people like to track their training, create content and share their progress.

You may photograph or film yourself at HP29 provided that you respect other people’s privacy.

When filming yourself

- Do not deliberately film another member without their permission.

- Do not position your camera so that another person is clearly identifiable in the background without their permission.

- Do not film Personal Training or other sessions involving another client without appropriate permission.

- Do not record private conversations.

- Do not obstruct equipment, walkways or other members while filming.

- Keep filming reasonably proportionate to the space and circumstances.

HP29, Trainers and Instructors

HP29 staff and Trainers may photograph or film training activity for HP29’s social media, website, promotional material or other marketing purposes where the appropriate consent has been obtained.

Individual Trainers may also create content for their own professional social media or marketing where appropriate consent has been obtained.

If you do not wish to appear in HP29 or Trainer marketing content, please follow the relevant consent/opt-out process.

17. PERSONAL BELONGINGS

Please take reasonable care of your belongings.

- Do not leave valuables unattended.

- Use designated storage where available.

- Do not leave bags or other belongings where they obstruct walkways or equipment.

- HP29 is not responsible for loss or theft except where legally responsible.

If you find something belonging to another member, please hand it to a member of staff.

18. HEALTH, ILLNESS & INJURY

Please do not train if you are unwell in a way that could make exercise unsafe or put other people at unnecessary risk.

You must tell your Trainer or a member of staff about relevant:

- injuries;

- illnesses;

- symptoms;

- changes in medication;

- medical advice;

- physical limitations.

If you become unwell, dizzy, unusually breathless, experience chest pain, feel faint or experience another concerning symptom during exercise:

Stop exercising and tell a member of staff immediately.

Where appropriate, HP29 may recommend that you seek medical advice before continuing exercise.

19. RESPECT FOR OTHERS

HP29 is intended to be a welcoming environment for everyone.

We do not tolerate:

- bullying;

- harassment;

- intimidation;

- threatening behaviour;

- abusive or aggressive behaviour;

- discrimination;

- sexual harassment or unwanted sexual behaviour;

- deliberately inappropriate or offensive conduct;

- threatening, abusive or intimidating communication towards staff, Trainers or members.

Treat people with the same respect you expect from them.

Concerns should be reported to HP29 management as soon as reasonably possible.

20. DRUGS, ALCOHOL & IMPAIRMENT

You must not train at HP29 while under the influence of alcohol, illegal drugs or any substance that materially impairs your ability to exercise safely or behave appropriately.

Staff may ask you to leave the facility if they reasonably believe you are impaired and your presence creates a safety or behavioural concern.

21. SAFETY & EMERGENCIES

Please familiarise yourself with the location of:

- emergency exits;

- fire exits;

- fire safety equipment;

- first aid equipment;

- any emergency communication points.

In an emergency:

1. Stop exercising.

2. Follow staff instructions.

3. Leave equipment safely where possible.

4. Evacuate using the designated route.

5. Do not re-enter the building until instructed that it is safe to do so.

Never obstruct fire exits, emergency routes or access to safety equipment.

22. DAMAGE & MAINTENANCE

If you notice damaged, faulty or unsafe equipment:

Do not use it. Tell us.

Do not attempt to repair gym equipment yourself unless specifically authorised to do so.

Members may be held responsible for damage caused by deliberate misuse, reckless behaviour or unreasonable use of equipment.

This does not mean you are responsible for normal wear and tear or accidental damage occurring through reasonable use.

23. FOLLOWING STAFF INSTRUCTIONS

HP29 staff, Trainers and instructors may give reasonable instructions relating to:

- safety;

- equipment use;

- session participation;

- capacity;

- behaviour;

- emergencies;

- cleanliness;

- the operation of the facility.

Members are expected to follow reasonable instructions.

If you disagree with an instruction, please raise the matter with HP29 management rather than continuing behaviour that has been identified as a safety or operational concern.

24. CHILDREN & YOUNG PEOPLE

Children may only attend HP29 where specifically permitted as part of an authorised children’s or youth Training Session.

Children must:

- remain within the designated session;

- follow the instructions of the coach/instructor;

- comply with the relevant age and supervision requirements;

- not use equipment or areas outside the session unless specifically authorised.

Children are not permitted to use the general Open Gym facility.

25. KEEPING THE GYM WELCOMING

We want HP29 to be somewhere people genuinely enjoy training.

That means:

TRAIN HARD.

Challenge yourself and make the most of your training.

TRAIN SAFELY.

Know your limits, use equipment properly and ask when you’re unsure.

RESPECT THE SPACE.

Put your equipment away and leave things better than you found them.

RESPECT THE PEOPLE.

Give others space, be considerate and treat everyone as you’d expect to be treated.

26. BREACHES OF THE GYM RULES

Most issues can be resolved with a simple conversation or reminder.

However, HP29 may take further action where someone:

- repeatedly breaches these rules;

- deliberately ignores reasonable safety instructions;

- behaves aggressively or abusively;

- deliberately or recklessly damages equipment;

- creates a serious or ongoing safety risk;

- engages in harassment, discrimination or threatening behaviour;

- otherwise seriously breaches the Membership Agreement or these Gym Rules.

Depending on the circumstances, this may include:

- a verbal or written warning;

- being asked to modify or stop a particular activity;

- removal from a Training Session;

- restriction of access;

- suspension of membership; or

- termination of membership,

in accordance with the HP29 Membership Agreement and applicable law.

Nothing in these Gym Rules limits any rights you have under applicable law.

27. CHANGES TO THE GYM RULES

HP29 may update these rules from time to time where reasonably necessary, for example because of:

- changes to the facility;

- new or replacement equipment;

- changes to services;

- health and safety considerations;

- changes to how the gym operates.

The current version will be made available to members.

Where a change materially affects your contractual rights or obligations, the relevant provisions of your Membership Agreement will apply.

28. MEMBER ACKNOWLEDGEMENT

By using HP29, you acknowledge that you have been given access to these Gym Rules and agree to follow them as part of your use of the facility.

These rules should be read alongside your:

- HP29 Membership Agreement

- HP29 Liability & Exercise Participation Waiver

- HP29 Pre-Exercise Health Screening & Readiness Questionnaire (PAR-Q)

- HP29 Privacy Notice

where applicable.
